Thomas A. Montiglio was successful in obtaining a defense verdict in the case of L.L, infant v. East Meadow UFSD, Supreme Court, Nassau County 2010 Defense Verdict – Plaintiff was a 5th grade boy who sustained a fractured tibia/fibula requiring 2 surgeries while shooting baskets on the school playground at recess. While shooting baskets by himself another group of 10-12 kids was playing a rough game of keep away on the adjoining court. One of the kids from this other group fell/was pushed into plaintiff causing the injury. The claim against the school district was negligent supervision. The jury returned a verdict of no negligence on the part of the School District.
