Robert Gresham v. Amboy Bus Company Supreme / Kings 2009

Angelo J. Bongiorno was successful in obtaining summary judgment dismissing the plaintiff’s complaint and all cross-claims against Amboy Bus Company.

The infant plaintiff, Robert Gresham, was a passenger on a school bus owned by Amboy Bus Company and driven by Bertha Jean-Joseph when the bus was involved in a motor vehicle accident.  The infant plaintiff testified that he was wearing is seatbelt at the time of the accident.  The infant plaintiff’s mother testified that her son missed about two weeks of school but his grades were not affected.  In addition, our doctors opined that the plaintiff sustained minor strains and strains.

The Honorable Gerald S. Held opined that the plaintiff did not sustain a serious injury as defined by New York Insurance Law and therefore Granted defendants’ motion for summary judgment dismissing all plaintiff’s claims against the defendants.
