										<content:encoded><![CDATA[<p>In <a href="https://bmmplaw.com/wp-content/uploads/2020/10/DECISION.pdf"><em>Min Ru Zheng v. Hyundai Marine &amp; Fire Ins. Co</em>.</a>, the Kings County Supreme Court found that the evidence clearly demonstrated that the plaintiff materially misrepresented the use and occupancy of the house to be insured.  The evidence showed that plaintiff had converted the house from the claimed two-family residence to a 12-family building.  Plaintiff&#8217;s claim that the house was occupied as represented was belied by the evidence, including her earlier statements that she was unaware of the nature of the occupancy.  Upon a motion to dismiss by BMMP’s William J. Mitchell, by Order dated October 1, 2020, Hon. Karen B. Rothenberg dismissed the plaintiff&#8217;s claims.</p>

										<content:encoded><![CDATA[<p>Aigul E. Sarvarova was successful in obtaining summary judgment dismissing the plaintiff’s complaint and all cross-claims against Jofaz Transportation, Inc. and Charles Cordero.</p>
<p>The plaintiff, Liliane Pimenetel, sustained injuries when she was involved in a motor vehicle accident with the bus owned by defendant, Jofaz Transporation, Inc., and operated by defendant Charles Cordero.  The plaintiff claimed that the defendant&#8217;s bus collided with her vehicle which caused her to sustain serious injuries.  Defendant&#8217;s bus driver denied contact with the plaintiff’s vehicle.</p>
<p>The Honorable Mark I. Partnow found that the defendants had met their burden of proof that there was no serious injury and the plaintiff did not meet the burden of demonstrating a serious injury.  Thus, Judge Partnow Granted defendants’ motion for summary judgment.</p>

										<content:encoded><![CDATA[<p>Angelo J. Bongiorno was successful in obtaining summary judgment dismissing the plaintiff’s complaint and all cross-claims against Amboy Bus Company.</p>
<p>The infant plaintiff, Robert Gresham, was a passenger on a school bus owned by Amboy Bus Company and driven by Bertha Jean-Joseph when the bus was involved in a motor vehicle accident.  The infant plaintiff testified that he was wearing is seatbelt at the time of the accident.  The infant plaintiff’s mother testified that her son missed about two weeks of school but his grades were not affected.  In addition, our doctors opined that the plaintiff sustained minor strains and strains.</p>
<p>The Honorable Gerald S. Held opined that the plaintiff did not sustain a serious injury as defined by New York Insurance Law and therefore Granted defendants’ motion for summary judgment dismissing all plaintiff’s claims against the defendants.</p>
